TERMS AND CONDITONS – NORTH AMERICA

1. Organizer

Pebeo (the “Contest Organizer” or “Organizer”) is organizing a free, no purchase necessary, online contest starting at 12:01 a.m. EDT on Wednesday, May 1, 2019, and closing at 11:59 p.m. EDT (UTC-4) on Wednesday, July 31, 2019 (“Entry Period”).

2. Participation Rules:

  1. Each artist may submit one (1) picture of one (1) original work.
  2. Collaborative works accepted, please include both names when registering.
  3. Artwork submissions must be uploaded during the Entry Period, to the contest submission form, available on Pebeo’s website (www.pebeo.com) and on Pebeo’s Facebook page (https://www.facebook.com/pebeopaints)
  4. Acceptable media: Any mix of Pebeo paints and mediums on canvas, board, wood, metal, plastic or acrylic (sculptures are acceptable too), in all cases, only using Pebeo products.
  5. Work should not be larger than 46’’x 38’’x 3’’ inches and not heavier than 22 LBS (10 kg).
  6. The photography of the work must comply with the artwork photography guidelines and will be checked for compliance. If the work is not shown on the Gallery of the submissions site at www.pebeo.com   within one (1) week after the submission this means the photo didn’t comply with the requirements.

3. Eligibility:

  1. There are no age restrictions for entrants; IF UNDER THE AGE OF 13, YOU MUST HAVE OBTAINED YOUR PARENT OR LEGAL GUARDIAN’S APPROVAL PRIOR TO ENTERING; if a minor is selected as a finalist in the contest, the parent or legal guardian must submit a written consent.
  2. A participant must be a legal resident of the United States/District of Columbia (excluding AZ, MD & TN), or a legal resident of Canada.
  3. Organizer, Judges and each of their respective parents, subsidiaires, affiliates, advertising/promotion/fulfillment agencies, and any and all other companies associated with the Contest (excluding Dick Blick Art Materials and  DeSerres employees), (collectively, the “Promotion Entities”), and each of their immediate family members (spouse, parent, child, sibling, and their respective spouses and children regardless of where they reside) and/or people living in the same household, whether or not related, are not eligible to enter or win. All Entries submitted are the property of the Organizer. This Contest shall be void where prohibited by law or regulation, and all eligibility is subject to all federal, state/province and local laws and regulations.

4. Use of Information:  

Consent to use the information gathered for the Contest applies to all those wishing to participate in the Pebeo Mixed Media Art Prize and Exhibition Contest, as well as to the Contest winner.

Photographs of exhibited works will be published in the exhibition catalogue and may be used by Pebeo for promotion of this and other Pebeo exhibitions, in social media.

5. Finalist Prizes (Open to Canadian and American residents ONLY):  

All submissions will be judged solely on their artistic meritas determined by the Judges in their sole discretion. The decisions of the Judges are final and legally binding in all respects and are not subject to additional review.

Canadian and American finalists will be selected by a jury of independent professionals, as determined by the Organizer, and in its sole discretion, from the art world (“Judges”), who will judge the works from the images and information submitted via the contest submission form. At the conclusion of the Judging period three (3) finalists from the United States and three (3) finalists form Canada (each a “Finalist”) will join up to 100 world wide Finalists to determine the grand, second and third prize winners.

  1. United States:
    1. 3 finalists are chosen from United States applications (Individuals who are legal residents of the United States/District of Columbia)
      1. Two (2) finalists are chosen from the general public entries.
      2. One (1) finalist is chosen from the pool of participants applying as a Dick Blick Art Materials employee (Employee must be currently employed at the time of the contest and be in good standing with the employer - Both will be verified with Dick Blick).
    2. All finalists from the United States receive a monetary prize of $2,000 USD.

Prize winners will also be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release, within (4) days of attempted notification or the prize may be forfeited. If any winner is a minor, the parent or legal guardian must complete the Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release.

Prize winners must reply with all required information in order to receive their prize.    

PUBLICITY RELEASE/ASSIGNMENT OF RIGHTS: Acceptance of any prize constitutes prize winner’s permission for the Promotion Entities to edit, publish, and use prize winner’s entry materials (or any portion thereof), name, photograph, likeness, voice, biographical information, statements and complete address (collectively, the "Attributes"), for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter devised, in perpetuity, without further compensation, permission, notice or authorization, (except where prohibited by law), and Entrant releases the Promotion Entities from all claims arising out of the use of such Attributes.

  1. Canada:
    1. 3 finalists are chosen from Canadian applications.
      1. Two (2) finalists are chosen from the general public entries.
      2. One (1) finalist is chosen from the pool of participants applying as a DeSerres employee (Employee must be currently employed at the time of the contest and be in good standing with the employer - Both will be verified with DeSerres).
    2. All finalists from Canada will receive a monetary prize of $2,500 CAD.

Entries made on another’s behalf by any individuals or other entities, including but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will be declared invalid and disqualified for this Contest. Tampering with the Entry process or the operation of the Contest is prohibited and any Entries deemed by Organizer, in its sole discretion, to have been submitted in this manner will be void. In the event a dispute regarding the identity of the individual who actually submitted an Entry cannot be resolved to Organizer’s  satisfaction, the affected Entry will be deemed ineligible. By entering, all participants and/or Entrants release the Organizer, Judge, Administrator, and their parent, subsidiary and affiliated entities including all of their respective shareholders, officers, directors, employees, agents, attorneys, successors and assigns from and against all claims and damages arising out of or in connection with each Entrant's participation and/or Entry in the Contest and/or his/her receipt or use of the prize awarded in this Contest.          

 

6. Distribution of Finalist Prizes (Open to Canadian and American Residents ONLY):

Finalists for the Mixed Media Art Prize and Exhibitions will be notified by email by August 15, 2019 before 11:59 pm.

If you have not heard from Pebeo by August 16, 2019 please assume that you have not been selected as a finalist for the Mixed Media Art Prize and Exhibition this time.

To be declared a finalist for the Mixed Media Art Prize and Exhibition and claim a prize, a selected participant must:

  1. be reached by email within three (3) days (72 hours) following the selection. Any selected participant who cannot be contacted after reasonable and appropriate efforts made by the Contest Organizer during this period of three (3) days will be disqualified;
  2. prove that they meet all the requirements of this contest (Country of residence, employment, authorization of legal representative if the Finalist is a minor). A person shall be disqualified if they fail to comply with any of the above-mentioned conditions or any other conditions specified in these regulations.
  3. Accept the conditions of consent and permission to use the photo of his/her work of art. A contract will be sent to the winners for signature, following the selection of their artwork.
  4. Agree to send the finalist artwork to Pebeo offices in Sherbrooke, Quebec, Canada within an agreed upon timeframe.

The winners will be informed of how to take possession of the prize within two (2) to four (4) business days of receiving the email.

In the event of a winner's refusal to receive the prize, or if the selected person does not meet above mentioned requirements, the Contest Organizer will not be held responsible for its delivery and may, at its discretion, award the prize to another person based on Judges decision.

Any litigation with respect to the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation with respect to the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

7. Shipment of Finalist Artworks to Menier Gallery in London:

All Finalists will receive specific instructions regarding how/where to ship their artwork, how to collect it after the exhibition, and any other relevant information to the final contest and exhibition at the Menier Gallery in London.

  1. Finalists are responsible for packing and shipping their artwork to Pebeo offices in Sherbrooke, Quebec, Canada. Must be received by the end of August to be included in the Grand Prize Judging. Shipping fees will be covered by Pebeo. Shipping details will be sent to the Finalists by email.
  2. Pebeo is responsible for shipping the Finalists’ artworks from Sherbrooke, Quebec, Canada to the Menier Gallery in London by September 20th, 2019 and back to Sherbrooke, Quebec, Canada after the exhibit. Shipping fees are covered entirely by Pebeo.
  3. Pebeo is responsible for shipping the artworks back to Finalists, when they return to Pebeo offices in Sherbrooke, Quebec, Canada from the exhibit in London. Shipping fees are covered entirely by Pebeo.
  4. Whilst Pebeo will take every reasonable care to look after works submitted for exhibition whilst in their care, no responsibility can be taken for damage, artists are advised to arrange their own insurance coverage, if required.

8. Contest Winner Prizes (Open to all Contest Finalists from around the world):

All submissions will be judged solely on their artistic merit.

Three (3) winners will be selected among the 100 Finalists from around the world, by a jury of independent professionals from the art world who will judge the works in person, at the Menier Gallery in London.

Winners of the Mixed Media Art Prize and Exhibition will be announced on the VIP night (October 1, 2019) at the Menier Gallery in London before 11:59 pm.

  1. The grand prize winner will receive a monetary prize of £3000;
  2. The second prize winner will receive a monetary prize of £2000;
  3. The third prize winner will receive a monetary prize of £1000.

9. Distribution of Contest Winner Prizes (Open to all Contest Finalists from around the world):

Winners who are present at the VIP Night at the Menier Gallery on October 1, 2019 will learn that they won during the official reveal by the judges and/or a Pebeo representative.

Winners who are absent from the VIP Night at the Menier Gallery on October 1, 2019 will be contacted by email the following day (October 2, 2019).

If you have not heard from Pebeo by October 3, 2019 please assume that you have not been awarded a winning prize for the Mixed Media Art Prize and Exhibition.

To be declared a winner and claim a prize, a selected participant for a prize must:

  1. prove that they meet all the requirements of this contest.
  2. correctly answer a mathematical question that will be sent by email.

The winners will be informed of how to take possession of the prize within two (2) to four (4) business days of the VIP night at the Menier Gallery or of receiving the email.

In the event of a winner's refusal to receive the prize or if the selected person does not meet above mentioned requirements, the Contest Organizer will not be held responsible for its delivery and may, at its discretion, award the prize to another finalist, based on jury decision.

10. Liability

WITH RESPECT TO THE CONTEST – APPLICABLE TO THE CONTEST ORGANIZER PEBEO, AS WELL AS CONTEST PARTNERS DESERRES IN CANADA AND DICK BLICK IN THE UNITED STATES.

  1. Pebeo, DeSerres and Dick Blick cannot be held liable in the event of an Internet malfunction preventing access to the contest or its proper functioning.  Pebeo, DeSerres and Dick Blick cannot be held liable for any third-party acts of Internet abuse.
  2. While Pebeo, DeSerres and Dick Blick shall do all in their power to provide users with information and/or tools that are accessible and verified, they shall not be held liable for any errors (particularly display errors on the Contest website), or for the absence or availability of information and/or the presence of a virus on the website.
  3. Participation in the contest implies knowledge and acceptance of the characteristics and limitations of the Internet, the absence of protection of certain data provided against possible misuse or piracy, and the risks of contamination by viruses circulating on the Internet.
  4. Participants must take appropriate measures to protect their personal data and/or software on their computer or telephone equipment from any kind of attack. All persons connecting to the website and participating in the contest shall do so at their own risk.
  5. Furthermore, Pebeo, DeSerres and Dick Blick shall not be responsible or liable in the event of:
  1. Pebeo, DeSerres and Dick Blick shall not be held liable for the consequences of any delay in email for which it is not responsible. Any claims must be sent by the recipient directly to the appropriate Internet service provider (ISP).
  2. In any case, if the smooth running of the Contest in administrative and/or technical terms are disrupted for any reason beyond the control of Pebeo, DeSerres, or Dick Blick, the contest organizer Pebeo reserves the right to suspend the Contest.
  3. Any fraud or breach of the present rules shall result in the disqualification of the entrant; Pebeo reserves the right, if warranted, to initiate proceedings against the defaulting party.
